Welcome to Glow Skin AI. These Terms of Service ("Terms") govern your use of the Glow Skin AI mobile application ("App") and related services provided by ONE PRO WEB LLC ("Company," "we," "us," or "our").

Please read these Terms carefully before using the App. By downloading, installing, or using Glow Skin AI, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using Glow Skin AI, you confirm that:

  • You are at least 13 years of age (or the minimum age in your jurisdiction).
  • If you are under 18, you have parental or guardian consent to use the App.
  • You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
  • You have the legal capacity to enter into this agreement.

2. Description of Service

Glow Skin AI is a skincare application that provides:

  • AI Skin Analysis: Analysis of your skin condition using photos you provide.
  • Product Scanner: Analysis of skincare product ingredients and compatibility with your skin profile.
  • Personalized Routines: Morning and evening skincare routine recommendations.
  • AI Chat Assistant: A conversational AI that answers skincare questions and provides personalized advice.
  • Progress Tracking: Trends and analytics showing your skin's improvement over time.

3. Medical Disclaimer

IMPORTANT: Glow Skin AI is NOT a medical service and does NOT provide medical advice, diagnosis, or treatment.

  • The App provides general skincare information and AI-generated recommendations for educational purposes only.
  • Results from skin analysis are estimates based on AI technology and may not be accurate.
  • Product recommendations are general suggestions and may not be suitable for your specific condition.
  • If you have medical concerns about your skin, consult a licensed dermatologist or healthcare provider.
  • Do not delay seeking medical advice or disregard medical advice based on information from this App.
  • If you experience allergic reactions, severe skin conditions, or any medical emergency, seek professional medical help immediately.

4. User Accounts

4.1 Account Registration

  • You must provide accurate, current, and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • One person may only create one account. Duplicate accounts may be terminated.

4.2 Account Responsibilities

  • You are responsible for all activities that occur under your account.
  • You must not share your account credentials with others.
  • You must not access another user's account without authorization.

5. Subscriptions and Payments

5.1 Free and Premium Plans

  • Free Plan: Limited features including 3 face scans per month and basic analysis.
  • Premium Plans: Full access to all features with monthly ($9.99/month) or yearly ($99.99/year) billing.

5.2 Free Trial

  • New users may be eligible for a 3-day free trial of Premium features.
  • The trial is available once per user. Creating multiple accounts to obtain additional trials is prohibited.
  • If you do not cancel before the trial ends, you will be charged for the selected subscription plan.

5.3 Billing

  • All payments are processed through the Apple App Store or Google Play Store.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends.
  • Prices may vary by region and are subject to change with notice.
  • We do not have access to your payment card details; these are handled by the app stores.

5.4 Cancellation

  • You may cancel your subscription at any time through your app store account settings.
  • Cancellation takes effect at the end of the current billing period.
  • You will retain Premium access until the end of the period you paid for.

6. Acceptable Use

You agree NOT to:

  • Upload photos of other people without their explicit consent.
  • Use the App for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or extract source code from the App.
  • Interfere with or disrupt the App's servers or networks.
  • Use automated systems (bots, scrapers) to access the App.
  • Circumvent any security measures or access restrictions.
  • Upload malicious content, viruses, or harmful code.
  • Harass, abuse, or harm others through the App.
  • Use the AI chat to generate harmful, illegal, or inappropriate content.
  • Impersonate another person or entity.
  • Violate any applicable laws or regulations.

7. User Content

7.1 Your Content

  • You retain ownership of photos and content you upload to the App.
  • By uploading content, you grant us a limited license to process, store, and display your content as necessary to provide our services.
  • You are responsible for ensuring you have the right to upload any content.

7.2 Content Guidelines

  • Photos must be appropriate and related to skincare analysis.
  • Do not upload inappropriate, explicit, or offensive content.
  • We reserve the right to remove content that violates these Terms.

8. Intellectual Property

8.1 Our Property

  • The App, including its design, features, AI models, algorithms, graphics, logos, and content, is owned by ONE PRO WEB LLC.
  • Our trademarks, service marks, and logos may not be used without written permission.
  • The App is protected by copyright, trademark, and other intellectual property laws.

8.2 License to Use

  • We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
  • This license does not include the right to modify, distribute, or create derivative works.

9. Third-Party Services

  • The App may contain links to or integrate with third-party services.
  • We are not responsible for the content, policies, or practices of third-party services.
  • Your use of third-party services is subject to their terms and conditions.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

  • We do not guarantee the accuracy, completeness, or reliability of skin analysis results.
  • We do not guarantee that the App will be uninterrupted, error-free, or secure.
  • We do not guarantee specific results from using the App.
  • AI-generated content may contain errors or inaccuracies.
  • We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ONE PRO WEB LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • We shall not be liable for any loss of data, profits, revenue, or business opportunities.
  • Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
  • We are not liable for any harm resulting from following skincare advice provided by the App.

12. Indemnification

You agree to indemnify, defend, and hold harmless ONE PRO WEB LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Content you upload to the App.

13. Termination

13.1 Termination by You

  • You may stop using the App at any time.
  • You may delete your account through the App settings.

13.2 Termination by Us

  • We may suspend or terminate your account if you violate these Terms.
  • We may discontinue the App or any feature at any time with reasonable notice.
  • Upon termination, your right to use the App ceases immediately.

13.3 Effect of Termination

  • Termination does not affect any rights or obligations that accrued before termination.
  • Sections relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

14. Changes to Terms

  • We may modify these Terms at any time.
  • We will notify you of material changes via the App or email.
  • Continued use of the App after changes constitutes acceptance.
  • If you do not agree to changes, you must stop using the App.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal complaint, you agree to contact us at support@glowskin-ai.com to attempt to resolve the dispute informally.

15.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15.3 Arbitration

Any disputes not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in class action lawsuits.

16. General Provisions

  • Entire Agreement: These Terms, along with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not constitute a waiver of that right.
  • Assignment: You may not assign these Terms. We may assign them without restriction.
  • Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control.
